I don't have much more information on that, but I did want to draw attention to a piece he published called, when does generative AI qualify for fair use? In this blog post, he walks through the Copyright Act of 1976 and the factors that affect whether something qualifies as fair use. Two of the major ones for generative AI is what is the market effect of the work. For example, companies like Stack Overflow and Chegg have experienced pretty steep declines ever since the release of ChatGPT. Another important factor is the purpose. Is it a commercial nature or is it educational? For example, if ChatGPT is commercially competing with its training data sources, then that complicates the issue of fair use.
