Many lawyers get it completely wrong when they're talking to new businesses about trademarks. I think that a lot of the discussion around trademarks is protecting your brand, and I don't think that's the right approach. I think the more important approach for most small businesses is making sure that your brand doesn't infringe on somebody else's. There are like millions and millions of trademark registrations out there, and now that we've gone from a local or regional economy to really a global economy, you need to be really careful about not starting a business or choosing a logo that's like really similar to someone else's, and you've got to do a search. So before you go and buy a domain or start an LLC or create a logo, you really should have a trademark lawyer do a search to make sure that somebody doesn't already have that name or logo or slogan.
